New York E&S Carrier Eligibility: Due Care After the 2026 List Changes

    Michael H. JenkinsOct 9, 20265 min read

    Key Takeaways

    • 1ELANY-listed status and the broker's file-level due-care obligation are related but distinct.
    • 2The exact underwriting entity and its status should be confirmed when coverage is procured.
    • 3Complete retail-broker submissions support both market selection and the statutory placement record.

New York excess line placements require more than identifying capacity. The placement file must support why the selected unauthorized insurer was eligible and how the excess line broker satisfied the applicable due-care obligation.

    What Changed in 2026

ELANY continued to update its list of E&S insurers throughout 2026. An August bulletin added two foreign insurers to the list: AXA XL Excess & Surplus Lines Insurance Company and MSIG Specialty Insurance America, Inc.

The operational point is not the names alone. ELANY explains that foreign insurers on its list have provided additional voluntary information for financial analysis. For those listed foreign insurers, ELANY maintains the records otherwise required under section 27.13 of Regulation 41.

Listed Does Not Mean Automatic Placement

ELANY's bulletin is explicit that the excess line broker remains responsible under New York Insurance Law section 2118 and Regulation 41 for using due care when selecting an unauthorized insurer. Eligibility is a threshold, not a substitute for file-level judgment.

For a retail broker, that distinction should shape the submission record:

  1. Confirm the legal entity — carrier group branding is not enough; the named underwriting company matters.
  2. Preserve the evidence — keep the quote, declinations, coverage comparison, financial information where applicable, and the final selection rationale together.
  3. Recheck at placement — insurer lists can change, so status should be confirmed when coverage is procured rather than inferred from an earlier conversation.
  4. Separate access from suitability — the availability of a market does not establish that its form, exclusions, limits, or financial profile fit the insured.
  5. What Retail Brokers Should Send

A complete submission helps the wholesale desk evaluate both placement fit and the eventual compliance record. The file should clearly identify the insured entity, operations, locations, requested limits, loss history, effective date, and any contractual requirements that drive form selection.

When a risk involves New York construction, the record should also make subcontracting, height exposure, contractual risk transfer, and Labor Law exposure visible at intake. Those facts can materially affect market selection and policy-form review.

    The Takeaway

New York E&S compliance is strongest when market selection and documentation happen as one workflow. Retail brokers do not need to duplicate the wholesale broker's statutory filing work, but they do need to deliver a record that supports accurate market review, form comparison, and timely completion of the placement file.

This article is general market commentary, not legal advice. Carrier eligibility and filing requirements should be confirmed for each placement.
